1.  TOWN OF LEESBURG
NOTICE OF PUBLIC HEARINGS
TO CONSIDER SPECIAL EXCEPTION APPLICATION TLSE 2008-0014 MCDONALD’S, LLC
TO ALLOW A RESTAURANT DRIVE-THROUGH FACILITY IN THE B-2 ZONING DISTRICT

Pursuant to Sections 15.2-1427, 15.2-2204 and 15.2-2285 of the Code of Virginia, 1950, as amended, the Leesburg Planning Commission will hold a public hearing on Thursday, April 1, 2010 at 7:00 p.m., and the Leesburg Town Council will hold a public hearing on Tuesday, April 13, 2010 at 7:30 p.m., in the Town Council Chambers, 25 West Market Street, Leesburg, Virginia, 20176, to consider a Special Exception to allow a restaurant drive-through facility in the B-2 (Established Corridor Commercial) zoning district. The proposed location of the facility is 335 East Market Street, Leesburg, Virginia, and is further identified in Loudoun County tax records with Parcel Identification Number (PIN) 231-20-3436.

The following modifications are sought with this application:

1. Modification of Town of Leesburg Zoning Ordinance (TLZO) Section 12.8.3, Screening and Buffer Yard Matrix requiring a buffer yard along east property line, from the required 10 (ten) feet with an S2 screen, to a proposed 1 (one) to 6 (six) foot wide buffer with no S2 screen.
2. Modification of Town of Leesburg Zoning Ordinance (TLZO) Section 12.8.3, Screening and Buffer Yard Matrix requiring a buffer yard along the west property line, from the required 10 (ten) feet with an S2 screen, to a proposed 2 (two) foot wide buffer, plus the existing 5 (five) foot wide buffer on the adjacent parcel, with limited S2 screen.
3. Modification of Town of Leesburg Zoning Ordinance (TLZO) Section 12.8.3, Screening and Buffer Yard Matrix requiring a buffer yard along south property line, from the required 10 (ten) feet with an S2 screen, to a proposed 8 (eight) foot wide buffer with decorative retaining wall and 6 (six) foot high opaque screen wall on top of the retaining wall, with limited S2 screen.
4. Modification of Town of Leesburg Zoning Ordinance (TLZO) Section 11.3, Number of Parking Spaces Required, to allow a minimum of 37 parking spaces instead of the required minimum of 40 parking spaces.

CHILD CARE FACILITY WITH A MAXIMUM CAPACITY OF 288 CHILDREN
IN THE B-2 (ESTABLISHED COMMERCIAL CORRIDOR) ZONING DISTRICT

Pursuant to Sections 15.2-1427, 15.2-2204 and 15.2-2285 of the Code of Virginia, 1950, as amended, the Leesburg Planning Commission will hold a public hearing on Thursday, April 1, 2010 at 7:00 p.m., and the Leesburg Town Council will hold a public hearing on Tuesday, April 13, 2010 at 7:30 p.m., in the Town Council Chambers, 25 West Market Street, Leesburg, Virginia, 20176, to consider a Special Exception to allow a child care facility with a maximum capacity of 288 children in the B-2 (Established Commercial Corridor) zoning district.

The subject property is located at 818 South King Street, Leesburg, Virginia 20175, and is further identified with Loudoun County Parcel Identification Number (PIN) 232-36-6858.
